GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale govern the contractual relationship between the company operating the website champagnefiercefit.com and any individual purchasing Champagne through the site.

With a commitment to selection and excellence, each cuvée offered is the result of a careful choice, reflecting a distinct identity, terroir and savoir-faire.

2. Products

The products offered for sale are Champagnes selected from independent vignerons.
Each product description aims to reflect their characteristics with accuracy; however, descriptive elements, including tasting notes, are provided for guidance only and shall not be deemed contractually binding.

3. Prices

Prices are expressed in euros (€), inclusive of all applicable taxes (VAT included), excluding delivery costs.
The company reserves the right to amend its prices at any time, it being understood that the price applied shall be that in force at the time of order confirmation.

4. Orders

Any order placed on the website implies full and unconditional acceptance of these Terms and Conditions.
Order confirmation constitutes an electronic signature and irrevocable acceptance.

The company reserves the right to refuse or cancel any order in the event of a prior dispute with the customer.

5. Payment

Payment is due in full at the time of order.
Transactions are carried out via secure payment methods available on the website.

6. Delivery

Products are delivered to the address provided by the customer at the time of ordering.
Delivery times are indicative.

Given the nature of the products (Champagne bottles), particular care is taken in packaging and shipping.
Risk is transferred to the customer upon handover to the carrier.

It is the customer’s responsibility to inspect the goods upon delivery and to notify the carrier of any damage or discrepancy.

7. Sale of Alcohol

In accordance with applicable legislation, the sale of alcohol to minors is prohibited.
By placing an order, the customer confirms that they are of legal drinking age.

8. Right of Withdrawal

In accordance with applicable law, the customer has a period of fourteen (14) days from receipt of the goods to exercise their right of withdrawal.

Products must be returned in their original condition, unopened and in their original packaging.
Return shipping costs remain the responsibility of the customer.

9. Liability

The company shall not be held liable for any improper use of the products, in particular where storage or serving conditions have not been respected.

10. Personal Data

Personal data are handled with the utmost care, in compliance with applicable regulations and in respect of the confidentiality inherent to the relationship with each customer.

11. Governing Law and Disputes

These Terms and Conditions are governed by French law.
In the event of a dispute, an amicable solution shall be sought as a priority.

Failing agreement, jurisdiction shall lie with the courts within the district of the company’s registered office.

Business

Per visualizzare i prezzi al netto dell’IVA riservati agli acquirenti con Partita IVA, è necessario registrarsi e accedere al sito con le proprie credenziali.

La società francese FCF FIER CE FÎT SARL, con sede a Reims, è identificata direttamente in Italia ai fini IVA. Pertanto, il regime di fatturazione elettronica non si applica alle fatture emesse o ricevute da parte nostra. La dichiarazione INTRASTAT è già stata effettuata da FCF FIER CE FÎT SARL, poiché la merce proviene da un Deposito IVA situato in Italia.

L'acquisto è classificato come un'operazione interna e non come un acquisto intracomunitario. Di conseguenza, i clienti di FCF FIER CE FÎT SARL sono esenti dall'obbligo di iscrizione al VIES.

Fattura a cliente italiano titolare di Partita IVA: Viene emessa una fattura non elettronica da FCF FIER CE FÎT SARL, utilizzando la partita IVA francese. La fattura è esente da IVA ai sensi dell’articolo 7 bis del DPR 633/72, e il cliente è tenuto a liquidare l’imposta applicando il meccanismo dell’inversione contabile (c.d. "reverse charge"), come previsto dall’articolo 17, secondo comma, del DPR 633/72 (cfr. risoluzioni ministeriali n. 89/E del 25/8/2010 e n. 21/E del 20/2/2015).
